Conditions of Hire
1. Application
These conditions apply whether or not the contract for private hire
or contract service has been entered into a result of a quotation
being offered and accepted or whether the contract has being made
verbally or in writing…
2. Quotation
Quotations are made subject to a vehicle suiting the hirer's requirements
being available at the time of acceptance. Quotations are based
on costs prevailing at the time and in accordance with details provided
by the hirer. Unless otherwise agreed, admission charges, meals,
accommodation, toll, and parking charges are not included in the
quoted price.
3. Use of vehicles
Unless confirmed in writing by Goomies Travel Ltd the vehicle should
not be assumed to remain at any point between the outward and return
journey, and not to remain available for the hirer's individual
use when parked at such points.
4. Drivers hours and rest periods
The hours agreed by Goomies Travel Ltd for the operation of any
hire must be strictly observed (other than in case of serious emergency
or diversion), so that current regulations governing drivers' hours
and rest periods can be complied with. Goomies Travel Ltd reserves
the right to curtail or otherwise alter any hire which does not
comply with relevant regulations.
5. Seating capacity
The hirer must not load any vehicle beyond the number of passengers
for which it is legally permitted to carry. Every passenger is responsible
for their wearing of seatbelts. Seatbelts must be worn at all times,
with the exception of when the vehicle is stationary and the passenger
is either boarding or alighting.
6. Animals
On all private and contract hires, no animal may be carried without
prior agreement of Goomies Travel Ltd.
7. Confirmation
All private and contract hires will not be regarded as confirmed
hires until written confirmation of each hire is received by Goomies
Travel Ltd.
8. Payment
All payment for private hire must be received by Goomies Travel
Ltd at least 10 days before date of hire, unless separate terms
have been agreed by Goomies Travel Ltd. Goomies Travel Ltd reserves
the right to add interest at the rate of 5% per month from the date
by which payment should have been made. All contract services are
due on receipt of invoice unless otherwise agreed by Goomies Travel
Ltd. All hires not paid for by the date due will be treated as cancelled
by the hirer.
9. Cancellation by hirer
In the event of cancellation by the hirer Goomies Travel Ltd reserve
the right to retain any deposit, or 25% of the hire cost and/or
in addition to this any cost incurred by Goomies Travel Ltd, but
not exceeding the full cost of hire.
10. Cancellation by Goomies Travel Ltd
In the event of emergency of force of majeure or of any notion by
the hirer to vary agreed conditions unilaterally Goomies Travel
Ltd may by returning all the money paid and without further or other
liability cancel the contract.
11. Route and variation
Should a vehicle be detained by the hirer or taken on a longer journey
than that contracted for Goomies Travel Ltd reserve the right to
make an additional charge commensurate with the costs incurred.
During the hire the driver is the sole judge of the reasonableness
of any request for the change of route or time. In the event the
vehicle(s) will depart at times agreed with the hirer; and Goomies
Travel Ltd will not be liable for any loss or injury sustained by
any passenger who fails to board a vehicle at the appointed time.
12. Substitution
Goomies Travel Ltd reserves the right to provide a larger vehicle
than specified at no additional charge (unless extra seats are used).
If extra seats are used, an additional charge will be made pro rata
to the hire charge. Goomies Travel Ltd reserves the right to substitute
vehicles (including with those of another operator) or ancillary
facilities, for all or part of the hiring.
13. Delays
Goomies Travel Ltd give any advice on journey time in good faith,
but do not guarantee the completion of any journey in any specific
time, and will not be liable for loss, delay, or inconvenience caused
by the actual time of the journey.
14. Agency agreements
Where Goomies Travel Ltd hire vehicles from another bus & coach
operator at the hirers' request, and where Goomies Travel Ltd arrange
ancillary facilities such as meals, accommodation, ferries, admission
tickets, or any other service provided by another supplier, it does
so as an agent for and on behalf of the hirer. Any terms and conditions
imposed by such other suppliers through Goomies Travel Ltd shall
be binding on the hirer as if he had directly contracted for such
services.
15. Passenger property
The driver is the sole arbiter as the carriage of passengers' luggage
and its storage. Goomies Travel Ltd will not accept liability for
any damage to or loss of any property left on a vehicle by a passenger.
All articles of lost property recovered from a vehicle will be held
at the depot at which the vehicle is based.
16. Conduct of passengers
The driver is responsible for the safety of the vehicle. Any passengers
whose conduct is in breach of statutory regulations may be removed
from the vehicle, or prevented from boarding on the drivers' authority.
The hirer will be responsible for the conduct of passengers and
any wilful damage caused to the vehicle by passengers during the
hire.
17. Complaints
Any complaints in respect of Goomies Travel Ltd services should
be made in writing to the Goomies Travel Ltd, Gullimore Farm, Sandy
Lane, Bushey, Hertfordshire, WD25 8HE within 21 days from the date
of hire.
18. Notices
No bill, banner, or poster to be displayed on any vehicle without
the consent of Goomies Travel Ltd.
19. Surcharge
When more than 28 days elapse between the hire being booked and
its execution, Goomies Travel Ltd may pass any increase in cost
as a surcharge, but any surcharge would be limited to a maximum
of 10% of the hire charge.
20. Alcohol & Smoking Policy
Goomies Travel Ltd operate a strict NO smoking and NO drinking of
alcohol policy on all their vehicles.
21. English Law
This contract is governed by English Law.
